Lee Da-hae hit with lawsuit for breach of contract

More trouble for actress Lee Da-hae, who is being hit with a lawsuit for dropping out of Coffee, the period spy film that cast Kim So-yeon to replace her.

According to the Seoul Central District Court on May 13, film production company Ocean Film filed suit for damages against the star and her management, DBM Entertainment. Ocean Film contends, “Ms. Lee agreed to appear in our movie Coffee and received 100 million won in salary. However, she decided to take a broadcast drama instead and informed us of her intent to drop the movie.” Now they are demanding payment for breach of contract, and are suing for 360 million won (approx $330,000 USD), citing compensation for damages.

DBM’s legal representative stated in a press release that they would fight back through whatever legal means necessary. Addressed in the statement were: the signing of Lee’s official contract, Lee’s salary for the movie, and the cause for her departure.

According to Lee’s management, they admitted to telling Ocean Film verbally that she wanted to do the film, but that no official contract had been completed. They did say, “We did draw up a simple informal contract when Ocean Film came to us asking for help in attracting investments. But we didn’t sign a contract booking Lee, so we have not received even one penny from Ocean Film. Therefore there are no grounds for them to demand damages twice as much as her pay.”

DBM also cited the failure of the production company to secure its proposed 10 billion won funding (which would have been necessary for Coffee to be the blockbuster it had been touting itself as) for leaving the project. That reason may be valid and true, but it doesn’t do much for Lee’s image as a star who leaves projects when they threaten to diminish her stature — sorry to say, but her public image has taken a lot of hits in recent years, and this doesn’t help things any. Especially given the existence of a contract promising her appearance — no matter how informal it may be.

Speaking of that contract, it sounds like Ocean Film may be trying to wring some money out of DBM, but the fact that there is one out there may complicate matters for the management team. Coffee was initially scheduled to begin filming in December 2010, but underwent various delays. DBM explained that Lee’s schedule for her upcoming drama Ripley was starting to conflict, so she dropped the film.

Lee’s new drama Ripley, on the other hand, will be premiering on MBC on May 30. I guess it was too much to hope for that she’d start a project without controversy, for once. Then again, it may help stir interest in the drama, in which Lee actually plays a controversial type of character, one based on an infamous liar and fraudster who set off a wave of scandals back in ’07. I suspect the drama character will be a much toned-down version of that type, though it would be great if they went whole hog and embraced her as an anti-heroine. (I don’t have much hope of that, though.)

LDH... poor girl. She does need a better management agency, doesn't she? When it happened [her dropping off projects] the first time, it was cool--understandable etc, etc... but after another one and then another one, it just leaves a bad tastes in some people's mouth. I feel that she's mostly misunderstood, but then again, she should not be so slack-ish into making sure these types of things don't happen again, right? I mean, it can't just be 'ooppss, sorry' again and again and again. And whether to hate on her or to love her, that's each and everyone's own prerogative, right? But seriously, I do WANT WORLD PEACE! lol..

I love Miss Lee Da Hae. But I have so many problems.

First, she is so pretty. I am just me.

Second, she is so tall. I am so short.

Third, she is a woman. I am a mouse.

Fourth, she is Korean. I am American. She is so far from me. We live in two different continents. I cry whenever I think about this.

Fifth, I can tell she likes a guy with a deep manly voice. My voice is so high and squeaky.

Sixth, I know she likes a guy who can laugh a deep manly laugh. I don't laugh. The good lord knows I have tried many times, but what comes out of my mouse....I mean mouth....is this high-pitched giggle. It drives me crazy. I worry that it will drive Miss Lee crazy too.

Lastly, I have a girlfriend. Her name is Minnie. I have spoken to her about my love for Miss Lee but she thinks I'm having a mid-mouse crisis. I am in my fifties, btw. This may seem old to you but it is actually very youthful in terms of mouse years.

Can someone pls help me? Do you think Miss Lee will ever take a mouse like me seriously? Thanks for reading my post. Cheese....I mean Cheers!

Well, I started out as someone who didn't know Lee Da Hae at all. But the articles here and the comments made me look her up and go through all her 'controversies'. It surprised me to find that barring the Filipino incident where she made a mistake (which was blown out of proportion), almost all the controversies were plain ridiculous. So I do not understand the tag 'controversy queen' first of all. Perhaps, some people think having a dress mishap or dropping out of projects which were not helping you at all is kind of a sin ("unprofessional" I guess is the word they would use), but I don't think so. Nor do I think it makes you evil if you defend yourself when others are making fun of you for things beyond your control. Come on, people, how many of you can say "I won't defend myself If I get bashed here". If we can't say that for ourselves, how can we expect her to stay silent after going through all that humiliation?

From the facts presented in the article, it seems there is not much substance to the lawsuit as Javabeans herself admits. At least a neutral observer might say that LDH didn't rake up the controversy on her own.

I know there's no point saying all these things here. Just that to keep silent would be a crime bcoz some people take what they read here as the truth. Imagine if there were no LDH supporters here, I would never have known the other side to the story. Now I can tell the difference between reporting facts and taking vicarious pleasure in another's misery. And I'm sure if we apply the standards that we use to judge celebrities to our own lives, many of us would be found wanting.

I simply didn't understand the need to link up the lawsuit which is her private thing with the character she is going to play when Ripley hasn't even started airing. If, in this blog, I had not seen all kinds of excuses being made for cliched rom-coms which were still declared as delightful, I would have perhaps given some thought to the lament over how Ripley is not bold enough to chart new territory. The feeling I got after reading the last paragraph was that JB will watch 'Ripley' only if LDH will play the irredeemable anti-heroine for she believes that Da Hae will be then playing herself.

I agree with SOME of your points (regarding the hate directed at her because of the controversies; its ridiculous)
My beef is with the blind hate towards JB.
Other than that i agree with you.
Actually eventhough this being touted as a traditional melo, the script is supposed to be excellent.
Come on KHJ was willing to be 2nd lead for this project because she Loved the SCRIPT
its not going to be bad and if anyone had bothered to search and read more detailed character descriptions its definitely not like thorn birds.

if u just recently look her up and read about her, then, u really dont understand all the hate.

i myself really liked her during her mygirl days. but as someone who trailed on everything she did(because i liked her), she really did changed to someone who is quite vain and arrogant. and her die hard fans doesnt help much too, they were too immature and people sometimes just get annoyed with this kind of people and want to make her fans annoyed too in return.

i dont understand why when people call out jbs dislike for ldh everyone assumee that person is a ldh fan? i dont even see how one correlates to the other. im neutral with ldh but even i can tell jb is less than impressed with the actress. its a simple enough observation so its pretty laughable that jb shippers seem determined to argue shes being neutral in this article when she clearly isnt.

Wow ! This is one of the few times I read all comments on a JB's article, but this was SOO fascinating. And not in a good way...

This is a blog, right ? It is a person's page to the world, and she can write what she wants, and we can choose not to visit the site, if we want.

I thought her article was pretty neutral, but giving a blog is a place where one voices one's thoughts out, even IF she wanted to bash Lee Da Hae, which she didn't, she's got every right in the world to do so.

Why don't people who disagree with her open up their own blog, try to get as many followers as JB has gotten through years of dedication to kdrama and US, and then say your piece.

as far as i know people come here and give opinions in discussing environment, except when suddenly the article is about LDH. i cant blame anyone except her fans. wow..this has definitely gone out of proportion.

first of all, i'm neither a fan nor an anti-fan of LDH. so from my POV, her controversies in the recent years has really affected her reputation in a negative light. the real reason..we don't know for sure but it did affect her image as a celebrity. plain and simple.

i honestly think that with her current celebrity status, she could actually assert which project/s she'll do. so i'm not really sure if the point where "she didn't have a choice" or "it was her management's decision" makes sense. IMO.

and please, stop harrassing JB and this blog. this is her space, her domain. i seriously don't get all the animosity. and besides, we all dislike some celebrities.

1. Philippines accent:
For what it's worth, she was doing South East Asian accent. I don't think she knew it would make Filipinos upset because as far as she's concerned, she never mentioned Philippines. Whether this is something some people get offended or not, that's up to each individual.

2. Paper tissue issue:
Just dumb and over exaggerated.

3. Coffee:
I have not idea what the real story is so I can't comment.

Here are her 2 biggest problems.

1. Her view on men and relationship. She's done an interview in which she stated what she expects from her guy. No need to go into details, but she really sounded like a big arrogant *&^%$ who thinks of men as slaves and that she is the center of the universe. This caused many anti fans to act up and many people very annoyed. Perhaps it was too blunt.

I've seen the interview and I think she somehow came off to the viewers as way too arrogant. She has to do a better in interviews and as the poster said, her management company has to better prep her for interviews. The good thing about this is that only small percentage of people have seen this infamous interview, even though her anti fans are posting it everywhere.

So she needs to get rid of her arrogant image.

2. The East of Eden situation:
Whatever the truth, most people..general viewers (meaning not fans or anti fans of the actress) has this idea that she left because her role was decreasing.
It's simple. Yes, you should be upset if the role has decreased more than you had expected, but you should have tried to work it out. You just don't get up and leave in the middle of the drama. I think that's how average people who cares about this situation thinks.

So, the actress has to work on some of these image problems. I think she'll be fine in fixing this. The infamous interview occurred more than 2 years ago, and people (excluding anti fans) tend to forget or not care about being irresponsible? disloyal? arrogant? and stuff even if they think she was being as such. I mean it's not something people will say oh I hate her so I won't watch her stuff. Let time pass, and most will forget. Just do better from now on. Work on coming off more humble. Be careful of being too blunt on how you think of yourself and others on TV.

She will be fine. As the writer has pointed out, her management company must do better to prep her for interviews and do a better PR job. Do a better job in explaining in her defense when she leaves a project or whatever that may bring her under negative light.

One more thought..

To LDH fans,

Kang Ji Hwan already paid the price for what he did. It is also the reason why his drama didn't promote him actively. So he is still paying for what happened. He also lost out on a project because of it. So lost of pay, lost of work, and lost of marketing value.

You shouldn't be too quick to raise another actor's name to justify LDH when she wasn't kept from acting and etc. She's promoting her drama fine, right? She wasn't forced to leave her projects right? To compare contract issue with agency is different than leaving projects. Both are different issues that are dealt differently.

No need for LDH fans to bring up other actors to justify LDH.

I'm her fan before and I'd say she better get her acts together. Its not like negative news about her are pure imaginations and inventions. If one want good press, good news only then be careful with own actions. viewers have own reasons, mine is I'll watch Ripley because of YooChun. I hope there will be Ripley recaps here. OH, There's news about Ripley being sold to Japan because of "YooChun effect". It's in the news last week:)
