Update: Screencaps, recaps, and Joo-won

What a morning. So stuff happened. There was a lot of emotion. And we here at Dramabeans realized once again what an awesomely supportive and fiercely loyal readership we have. We love you. ♥ Really, it was surprising and touching to see how much people care about this site and what we do. We wouldn’t be here without you.

Here’s what happened: Sites that infringe on material covered by Dramafever’s licensing agreements have been shut down in the past. The company that Dramafever hired to handle these cases saw that we covered a show they licensed. They filed the DMCA notice with our webhost, who warned us to delete or be shut down. We deleted (and replaced with lovely stick figures. You’re welcome).

We have spoken with reps from Dramafever, who have issued their official statement. They retracted the DMCA notice and have informed us we can resume screencapping. We’re a little gun-shy about that at the moment (hence the stick figures. You’re welcome), but will try easing back into normal operating procedure and bringing back the pretty.

We have to admit that the recent shakeups in the drama fan community have us uneasy, from streaming site and torrent crackdowns to fan recap sites being taken offline, and we’re not quite sure how the landscape may change in the future. We’re grateful to still be here, and we’re committed to sticking around, even if that requires evolving with the shifting sands (and maybe learning how to draw better stick figures). So thank you again for all the love and support, which is what keeps us going. Y’all rock.

There is a little bit of advice in the business world that states when you want something done, copy everyone.
I know that the statement recanting the letter was issued. I appreciate the prompt address of our concerns.

That said, I'm still writing to DF. In the next 10 days I will be mailing several letters. I am writing to DF, I am writing to Hulu, my congress people, the White House, the Blue House and all of the heads of the major stations (cable too) in Korea. And all letters will be copied to all of the other parties.

As for here I will go back to my years of lurking (several times each day and usually my first non-work, non-weather internet), but my support and deep appreciation is ever yours.

Yey!!! to JB, GF and the DB crew... I've stated my mind and I tell you my I felt like the wind got sucked out of me this morning with your news, truly SCARY!!!.. Really, truly heart breaking.. but luckily it's been corrected!!! Big, big sigh of relief!!! Right, or is there some hidden clause... I sure hope it's truly all over...

How heartwarming the big support you truly have from us your fans!!! We truly love you guys!!! Mwahh, fighting and God bless you all for bringing enjoyment to this sometimes gloomy world!!! THAnKS FOR ALL YOU DO!!!

Gosh, they must have really clever people at DF. I hope this means that they have driven more people away from DF and over to viki. So would that mean that DF will have fewer licensing rights if fewer people are watching at DF? Here's hoping that viki will get more licensing rights in the future.

Way to go girls and all you Beannies. I'm a little sad though. I was so looking forward to the stick figures.

I don't comment as much, however, I have been your avid fan since 2009. (if I'm not mistaken)Love to read your recap, comments and insights. Actually, afterwork the first thing I do, turn on my PC (don't want to use my Iphone since it small screen) and click on your site. As soon as I get my Dramabeans fix, my day is complete and I feel a lot better for real. :)

i am relieved that all is well now. like many many commenters here, http://www.dramabeans.com is a daily fixture in my life and i would not have found dramafever, viki or the other sites without this blog. this is by far the BEST kdrama blog out there and any attempt to mess with it is NOT okay. i hope this doesn't happen again but am glad to know there are ride-or-die beanies with whom i can band together and protect this integral part of kdramaland.

I did want to mention that you're not without recourse in these situations, either:

If you're interested, Fanlore has an archive of articles tracing the development of fair use laws and fan production from 1992 to the present. http://fanlore.org/wiki/Legal_Analysis

There are also legal scholars working on fandom and fair use; see Rebecca Tushnet's writing, for example. http://www.tushnet.com/law/law.html

Lastly, the Center for Social Media (a US institution) addressed the question of screencaps for fandom purposes in 2009. Reading recaps help makes my drama-viewing more easier to understand because sometimes there are things that I don't understand and reading recaps help clarify it so much better.

Thank you javabeans and girlfriday for all your hard work recapping and screencapping! I've gotten into so many dramas from your recaps here.

I'm still curious about why they targeted Level 7 Civil Servant specifically and why the warning had to be done through a third party and then through your webhost. You'd think they'd try to hire the right people, keep an open channel of communication, be on top of things, and have the courtesy to send shut-down emails themselves instead of having a third party do it.

I've found this development to be particularly disturbing. "Fan recap sites being taken offline" especially since those site mostly serve to drive up viewership.

Yay... I am soo happy for you... I love to watch Viki and the only time I watch Dramafever is when some of the dramas that is not license on viki. I watch it. I just hope that viki has more dramas to license then dramafever.

Oh wow, I've only gotten into this today. :/

I've barely uttered a peep on this site, but please know that I am a loyal fan who's been quietly enjoying your recaps and articles and the utter awesome you always serve up here. Recaps are one thing, but thoughtful statements on the "why I like/don't like this drama" are another. I honestly would not have gotten to know some of the most compelling storytelling I've ever experienced had it not been for Dramabeans, so thank you, ladies! :)

Great to see DF come to their senses, I was shocked considering I only heard about them through this site and couldn't believe that they would so readily turn their backs on the same people who brought awareness to their site.

Keep doing what you guys are doing because, honestly you guys are one of the main sites if not the main site that every K-drama lover turns to when they discover this awesome world of arrogant hero's and makjang. If anything I think you guys play a major role in helping to bring together K-drama lovers around the world and so patiently, with such great humor help us to understand and explore not only the drama buts also the culture and language. Love this site and hope that nothing like this happens again because it would be such a great loss.

I like all your readers and supporter, want to thank you for the amazing job you do bringing us all things K-drama related. Even though I'm mainly a reader I check dramabeans EVERY day, throughout the day. I' m glad that DF realized that their initial decision was unwise (stupid, insane etc). Although I must say that when I think of DF the first word that comes to mind is...bully. I hope that K-drama fans continue to voice their displeasure with DF's actions.

Gah, as happy as I am for Korea for all the attention its getting these days, it's times like these that I really miss the good ole Kdrama days where you had to search like crazy to find subs and the community was smaller and closer knit and no one cared about what we did. *sigh*

That is interesting, I didn't realize that there was a third party that companies employed to send out DMCA notices- if I were them, I'd prefer to have my own lawyers handle that. So this third party then couldn't tell the difference between illegal streaming video and some posted screen caps. Hmm.
